Terms and Conditions

For consumers (private individuals), Duthler Academy applies the General Conditions for Private Education and Training of the NRTO. These can be downloaded here.

1. General

1.1.      The Data Protection Officer Training Program (hereinafter: “DPO Training Program”) is offered to you by Duthler Academy, a part of Duthler Associates Ltd. With the registration by the contract student – as referred to in art. 2 – an agreement is made between the contract student and Duthler Associates Ltd..

Duthler Academy works together with partners (also known as “connected persons”) in the context of the DPO Training Program. For example, between Duthler Academy, Duthler Associates Ltd. and First Lawyers Ltd. concluded a cooperation agreement that makes it possible to offer the DPO Training Program and in which the mutual rights and obligations are laid down.

The DPO Training Program consists of four clusters, namely A.) formal legal; B.) governance & compliance; C.) equipment, design, existence and operation of measures and mechanisms; D.) assessment & audit. Each cluster consists of separate modules.

1.2.      In principle, a candidate contract student registers for the entire DPO Training Program. However, it is also possible to follow separate clusters and / or modules of the DPO Training Program. The registrations take place on the basis of the “Registration form DPO Training Program”. The total costs for the training will be charged by Duthler Academy to the contract student or his employer.

1.3.      These general terms and conditions apply to the entire DPO Training Program, all separate clusters, modules, related activities and services and quotations from Duthler Academy. The individuals authorized by Duthler Academy to accept enrollments on its behalf are referred to as “partners”.

1.3.      All registrations are deemed to have been made exclusively to Duthler Academy and not to any person associated with Duthler Academy.

1.4.      Not only Duthler Academy, but also any person associated with Duthler Academy can invoke these general terms and conditions. The same applies to successors under universal title of related persons, formerly related persons, and the legal successors under universal title of formerly related persons.

1.5.      Deviations from these general terms and conditions are only valid if they have been expressly agreed in writing. The applicability of conditions of the contract student or his employer is expressly rejected.

2. Registration and participation

2.1.      Enrollment is done by returning the fully completed “Registration DPO Training Program” (hereinafter: “Registration Form”), dated and signed, including the documents indicated on the Registration Form, to Duthler Academy (Duthler Associates Ltd. , attn. Duthler Academy, Frankenslag 137, 2582 HH, The Hague or by e-mail to info@duthleracademy.nl.

2.2.     In principle, enrollment is for the entire course of a nominal two years, unless the parties deviate from this in writing in the training plan.

2.3.      Enrollment is final when (i) Duthler Academy has confirmed the eligibility of the Contract Student Candidate in writing to the Contract Student and (ii) Duthler Academy has received payment from the Contract Student, or their employer. The aforementioned conditions apply cumulatively.

2.5.      When the contract student is definitely enrolled, the contract student will be guided and facilitated by Duthler Academy for a maximum of 26 months. If the certificate is not obtained within this period, it is possible to complete the DPO Training Program as long as the DPO Training Program, the relevant cluster or clusters and / or the relevant module (s) are offered by Duthler Academy and its cooperation partner.

3. Education and Examination Regulations (EER)

3.1.      The EER contains information about the DPO Training Program and establishes the applicable procedures and rights and obligations of the contract student and Duthler Academy with regard to education and exams. The contract student and his employer are obliged to adhere to the EER of Duthler Academy. By registering, they explicitly declare the EER applicable and declare that they are willing to cooperate with the required formalities and procedures.

4. Entry conditions and requirements

4.1.      Condition:

  • Registration for the course, clusters and / or modules of Duthler Academy is open to anyone who has reached the age of eighteen and no objections have arisen from the intake interview prior to registration, at the sole discretion of Duthler. Academy;
  • Further rules may be imposed on the order in which students can register for clusters and / or modules within the study program and on the further substantive requirements for the prior education level;
  • At the first enrollment, the contract student must show a valid proof of identity, so that Duthler Academy can establish the identity of the contract student.
  • With regard to the further substantive requirements for the prior education level, clusters and / or modules, the contract student must at least be in possession of an Bachelor or Master diploma, or must have demonstrable knowledge of an equivalent level at the discretion of the admission committee.

5. Registration date and registration period

5.1.      The day of registration for the DPO Training Program, clusters and / or modules of Duthler Academy starts on the date that the registration form is returned to Duthler Academy (see also what is stipulated under Article 2.3).

5.2.      The registration period is 26 months for the DPO Training Program from the day of registration.

6. Rights from registration

6.1.      Registration gives the right to examinations, the use of an e-Learning environment, the right to receive course material and to the training, clusters and / or modules available for the student:

  • Attending and participating in workshops organized by Duthler Academy for the entire course, clusters and / or modules;
  • A total of four hours for (written or oral) answers to specific questions. For answers to questions that require more time, the normal hourly rate of cooperation partners is charged;
  • Access to a private portal that Duthler Academy has provisioned and is managed by Duthler Academy. The login details for this portal must be kept strictly confidential and may not be disclosed to others.

7. Termination of (rights from) registration

7.1.      Registration ends:

  • due to the expiry of the registration period;
  • due to the death of the contract student;
  • at the written request of the contract student. A request for termination of the DPO Training Program, clusters and / or modules must be addressed by the contract student by registered letter to Duthler Associates Ltd., attn. Duthler Academy, Frankenslag 137, 2582 HH, The Hague;
  • if it can be attributed to the contract student or his employer that fulfillment from the obligations on the basis of the registration is not, not timely or incorrectly, Duthler Academy is authorized, after a summons by registered letter, after hearing the contract student, to register the registration without judicial intervention. terminate or suspend; and
  • premature termination of enrollment for whatever reason does not relieve the contract student or his employer from the obligation to pay the full course fee.

8. Training amount, payment and cancellation scheme

8.1.      Costs for participation in the DPO Training Program, or separate clusters and / or modules, are determined per contract student using a training plan and apply for the duration of the training. The training plan is part of these general terms and conditions.

8.2.      When registering for the DPO Training Program, the contract student owes a fee to be determined for the entire DPO Training Program, or individual clauses and / or modules. The contract student or his employer pays this fee to Duthler Academy.

8.3.      All invoices will be paid by the contract student or his employer in accordance with the payment conditions stated on the invoice. In the absence of specific conditions, the contract student or his employer will pay within fourteen days of the invoice date. The invoice date must be regarded as a deadline.

8.4.      Payment by the contract student or his employer takes place without settlement or suspension.

8.5.      Up to three weeks before the start date of the DPO Training Program, or the cluster and / or the module can only be canceled in writing (see art. 7.1 under c). We charge € 225, – excluding VAT for administration costs. In case of cancellation within three weeks before the date of the DPO Training Program, the cluster, the module, we will charge the full amount, even if the registration took place within this period. Refund of amounts paid is then no longer possible. It is possible to send a deputy.

In consultation, it can be decided to move on to a course, cluster or module at a later time.

9. Course program

9.1.      Duthler Academy reserves the right to make teacher, program and / or location changes. Participants will be informed of any changes prior to the training, insofar as they are known to Duthler Academy in time.

9.2.      The content of the DPO Training Program and the preparation of the training plan is based on the information provided by the contract student. The contract student guarantees that to the best of his knowledge he has provided all essential information for the design and implementation of the DPO Training Program. Duthler Academy will perform the work to be performed to the best of its knowledge and ability. These obligations have the character of a best efforts obligation.

10. Privacy

10.1.    We process data from the contract student and his employer for the implementation of the DPO Training Program and to provide them, also by e-mail, with information in your field of expenditure and services of Duthler Academy and its cooperation partners. An unsubscribe option is included in every e-mail. If you do not appreciate this information at all, including products and services from third parties carefully selected by the Duthler Academy, you can report this in writing to Duthler Associates Ltd., attn. Duthler Academy, Frankenslag 137, 2582 HH The Hague or by email via servicedesk@duthleracademy.nl.

11. Liability / disclaimer

11.1.    Duthler Academy and its affiliated persons do not accept any liability for damage suffered by the contract student, his employer or third parties in connection with the training from any cause, theft or loss and any consequential damage or product damage, except for the other party. evidence, intent or willful recklessness of Duthler Academy and / or associated persons.

11.2.    In the unlikely event that Duthler Academy and / or its associated persons are nevertheless obliged to pay compensation for damage, this compensation will never exceed the invoice price of the contract student or of the work performed (see also art. 8.2).

11.2.    Although the content of the DPO Training Program, clusters, modules, website and e-Learning (hereinafter also referred to as: “the educational material”) has been carefully compiled, Duthler Academy cannot guarantee the correctness or completeness of the educational material. Duthler Academy accepts no liability whatsoever for any damage, of whatever nature, arising in any way from the use of the educational material, including acts, omissions and / or decisions based on the intended educational material, as well as the (temporary) inability to use the teaching material.

11.3.    Duthler Academy does not accept any liability for the content of the information provided by associated persons. This includes, but is not limited to, infringing copyrighted work (s) or otherwise acting in violation of the intellectual property rights of third parties.

11.4.    If an event occurs during the performance of the DPO Training Program that leads to liability of Duthler Academy, then that liability is limited to the amount that is paid out under the liability insurance taken out by Duthler Associates B.V. in that case.

11.3.    A condition for the existence of any right to compensation is always that the contract student reports the damage in writing to Duthler Academy immediately after it has arisen.

11.4.    Any claim for compensation will lapse one (1) year after the start of the day following the day on which the client became aware of the damage and Duthler Academy as the person liable for it.

11.5.    If Duthler Academy engages a person affiliated with it in the performance of the DPO Training Program, Duthler Academy is not liable to the contract student or his employer for any error that may be made by the affiliated person. With enrollment at Duthler Academy, Contract Student grants Duthler Academy the authority, if a person engaged by Duthler Academy wishes to limit their liability, to accept that liability also on behalf of Contract Student.

11.6.    The limitations of liability and reimbursement rights included in these general terms and conditions also apply to every person associated with Duthler Academy, persons associated in the past and legal successors under the general and special title of the associated persons. The connected persons can invoke these general terms and conditions.

12. Intellectual ownership

12.1.    Documents, ideas, data, models, techniques, instruments, writings, including software, products subject to intellectual property rights or other information used for the implementation of the DPO Training Program, are and will remain the property of Duthler Academy and / or its collaboration partners . Disclosure can therefore only take place after obtaining permission from Duthler Academy and / or its collaboration partner. In the event of premature termination of the DPO Training Program, the foregoing applies mutatis mutandis.

12.2.    Except for the exceptions set out in the Copyright Act 1912, nothing from the (course) material of Duthler Academy may be reproduced (including storage in an automated data file) and / or made public by means of print, photocopy, microfilm or on any other, without the prior written consent of Duthler Academy.

13. Confidentiality

13.1.    Parties are obliged to observe strict confidentiality with regard to all confidential information with which they come into contact during the execution of an assignment. Confidential information is in any case considered to be all materials (including methods, hardware / software), documents, ideas, data, products subject to intellectual property rights or other information. Information will in any case be regarded as confidential if it is indicated as such by one of the parties. In the event of premature termination of the DPO Training Program, the foregoing applies mutatis mutandis.

14. Applicable law

14.1.    Dutch law applies to these general terms and conditions and the legal relationship between Duthler Academy and its contract students or its employer. However, only The Hague is authorized to hear any dispute between Duthler Academy and contract student in the first instance.

Duthler Academy is part of Duthler Assocates Ltd. Duthler Associates Ltd. is established in The Hague and registered in the trade register under no. 27173205.

There is a Dutch and an English version of these general terms and conditions. In the event of any discrepancy between the Dutch version and the English version, the Dutch version will prevail.
