The DPO: position, duties, powers and responsibilities

The European General Data Protection Regulation (GDPR) further regulates the appointment of the data protection officer (DPO), the position in the organization and the tasks and powers. In comparison with the Dutch Wbp, we can say that the GDPR further colors the function of the DPO. After this module, participants will know the most important requirements that the Dutch Wbp and GDPR set for the position of the DPO and his duties, powers and responsibilities. The participants also have insight into the main differences with the Dutch Wbp. Participants are also provided with tools for the further interpretation of their function and position.

Content

In this module, participants learn the legal background of the DPO position. The development of the formal legal rules regarding the DPO from the European Directive in the Wbp and ultimately the GDPR will be discussed. This module also discusses the material and practical aspects of the DPO position. This module discusses what the formal rules mean for the functioning of the DPO in practice. Topics discussed include: the position in the organisation, the relationship with the responsible party, with the information security officer and with the supervisor, the role of the DPO in DPIAs and data leaks and the tension between the advisory and supervisory duties.

Obligations associated with this part

To fulfill the obligations under this section, you must:

  • Make a diagnostic test, in preparation for the subject matter to be followed;
  • Take a diagnostic test after the self-study, which must be completed with a pass. This is a condition for participation in the workshop;
  • To be present during the workshop;
  • A final exam with a passing mark.

Study load

The self-study takes about 16 hours, the workshop takes about 4 hours and the final exam takes about 2 hours.
